1. Introduction

Welcome to Spaniversity! By accessing our website, enrolling in classes, or making payments, you agree to these policies governing your participation in our Spanish language tutoring services. These terms apply to all services, including online lessons, in-person private lessons, and group classes.

2. Services Provided

Spaniversity offers a variety of language learning formats. All lessons (including lesson packs) are valid for 6 months from the date of purchase. Expired sessions are non-refundable and non-extendable.

  • Private Online Lessons: 1-hour sessions conducted virtually.
  • Private In-Person Lessons: 1-hour sessions conducted at a mutually agreed location.
  • Private Group Classes: 55-minute sessions for groups self-formed by students of similar proficiency.
    • Group Size: Minimum of 2, maximum of 5 students (unless otherwise specified).
  • In-Person Public Group Conversation Classes:
    • Format: 55-minute conversation-focused sessions designed primarily for intermediate-level Spanish learners (all levels welcome).
    • Group Size: Minimum of 4, maximum of 8 students (unless otherwise specified).
    • Location: Pre-selected public locations in Downtown Santa Cruz, CA and Mid-County Santa Cruz, CA (unless otherwise specified).
    • Scheduling: Specific dates, times, and locations are published on Spaniversity.com.
    • Minimum Enrollment: Classes require a minimum of 4 students. If this minimum is not met, Spaniversity reserves the right to cancel the session (see Section 6.3 for details).

3. Account Eligibility

  • General Eligibility: Users must be 13 years or older to utilize Spaniversity services. Students under 18 require written parental or guardian consent.
  • Public Group Restriction: Participation in In-Person Public Group Conversation Classes is restricted to adults (18+ years old) only.

4. Payment and Billing

  • Processing: Payments are processed securely through Stripe. We do not store credit card numbers.
  • Timing: Full payment is required before the first session or lesson pack begins.
  • Pricing: Pricing is subject to change for future bookings.

5. Scheduling, Attendance, and Punctuality

We value your time and the time of our instructors. Please review the following attendance rules carefully.

Scheduling

  • Private sessions are scheduled by mutual availability.
  • Public Group classes follow the schedule published on our website.
  • Students are responsible for tracking and attending their scheduled sessions.

Punctuality

Sessions start promptly at the scheduled time.

Late Arrivals

  • Instructors wait up to 15 minutes past the scheduled time for private lessons; after that, the session may be marked as completed/missed.
  • For group classes, late arrivals are welcome to join, but sessions will end at the scheduled time without extension.
  • Time lost due to late arrival is not made up or refunded.

No-Shows

Failure to attend a scheduled session without prior notice is counted as a completed session (see Section 6.2 for details).

Group Attendance

There are no make-up classes for missed group sessions by individual students.

6. Refunds, Cancellations, and Rescheduling

To ensure fairness and consistency for our instructors and students, Spaniversity maintains a strict cancellation policy.

6.1 No Refund Policy

All purchases, including Individual Private Lessons, Private Lesson Packs, and Group Classes, are non-refundable. By purchasing a service, you acknowledge that all sales are final, ensuring reliable scheduling for everyone.

6.2 Rescheduling Policy

  • Notice Required: Sessions may be rescheduled if notice is provided at least 48 hours before the scheduled time.
  • Private Groups: Group lessons may be rescheduled by the entire group with at least 48 hours' notice, subject to instructor availability.
  • Forfeiture: Missed sessions or cancellations made with less than 48 hours' notice are forfeited and are not eligible for rescheduling or credit.

6.3 Cancellations by Spaniversity

  • General Cancellations: If a session is canceled by Spaniversity (e.g., instructor illness or emergencies), students may choose to reschedule or receive account credit. No cash refunds will be issued.
  • Low Enrollment (Public Groups): If an In-Person Public Group Class is canceled because the minimum enrollment (4 students) is not met, Spaniversity will notify registered students at least 48 hours before the scheduled time. In this specific case, Spaniversity may offer to reschedule the class or offer an online alternative.

7. Code of Conduct

  • Students must treat instructors and fellow students respectfully.
  • Disruptive or inappropriate behavior may result in immediate removal from the course or platform without refund.

8. Liability and Waiver

  • Assumption of Risk: Participation in all sessions, particularly in-person appointments, is at your own risk.
  • Disclaimer: Spaniversity is not liable for internet issues, device/software failures, or personal injuries occurring during in-person sessions.
  • Waiver: By participating, you acknowledge all associated risks and expressly waive rights under California Civil Code Section 1542.

9. Privacy and Data Protection

  • Data Collection: We collect personal data (name, email, phone) and class data (scheduling, goals) to deliver services. Technical data (IP address, cookies) is collected to improve site functionality.
  • Use of Data: Information is used to process payments, personalize classes, and send updates.
  • Sharing: Data is shared only with Stripe for payments, service providers under confidentiality, or legal authorities as required.
  • Your Rights: You may access your data, request deletion (subject to legal compliance), or opt out of promotional communications at any time.

10. Intellectual Property

All Spaniversity content is protected by copyright and intellectual property laws. Users may not copy, modify, or distribute materials without written authorization.

11. Miscellaneous

  • Governing Law: These policies are governed by the laws of the State of California, USA.
  • Third-Party Services: Spaniversity is not responsible for content or damages from third-party websites or tools linked through our platform.
  • Updates: These policies may be updated periodically. Continued use of services after changes constitutes acceptance of the revised terms. Material changes will be communicated directly to users.
